Netbook Design Challenge

Welcome to the Netbook Design Challenge Contest! Design your own Cellular South wallpaper for a netbook and have a chance to win your own netbook and some cash! 
 
Creative Assignment


Entrants should design a customized image or submit a photograph that could be used as a wallpaper design for our NEW netbook.  Cellular South’s logo or colors must be incorporated, and it needs to fit in one of the following categories: 

Abstract – Art is in the eye of the beholder.  Make this design as wild and as different as you like.  Be creative!


Sports – What’s your favorite sport?  Incorporate any sport that you desire from football to ping pong, any sport is fair game!


Outdoors – Camouflage, an outdoor scene or even wildlife can be incorporated into this theme. 


Old School
– Design a retro look from your favorite past decade.  Whether you like groovin’ in the 70s or rockin’ in the 80s, the choice is up to you!


Future – What does the future hold?  You determine what you want the future to look like. 

Design Creation Requirements  


• Images must be at least 1024 X 576 pixels in size
 
• Images can be in png, jpeg or gif format and no more than 30MB

 Photos can be shot with camera phones, digital photo cameras or any other camera format but must be converted to a digital image format for entry to the contest.

CELLULAR SOUTH® Netbook Design Challenge
 
OFFICIAL RULES & REGULATIONS
8:00 AM CT, June 22nd, 2009 through 11:59 PM CT, July 19th, 2009
 
 
THE FOLLOWING CONTEST IS INTENDED FOR LEGAL RESIDENTS OF THE UNITED STATES WHO RESIDE IN THE STATES OF ALABAMA, MISSISSIPPI AND TENNESSEE ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW.  DO NOT PROCEED WITH THIS CONTEST IF YOU ARE NOT A LEGAL RESIDENT OF THE STATE OF ALABAMA, MISSISSIPPI OR TENNESSEE.
 
Cellular South, Inc. (hereinafter referred to as Cellular South) will conduct the “Netbook Design Challenge” Contest from 8:00 AM CT, June 22nd, 2009 through 11:59 PM CT, July 19th, 2009.  The Contest entries will be hosted by Memelabs and prizes will be awarded on the following basis:
 

Overall Prizes:  Three (3) Overall Prizes with a total value of $4,000 as follows:

1st place =     $1,500
One (1) netbook (approximately $400 value)
netbook service for a year (approximately $600 value)
(Total 1st place prize value = approximately $2,500)

2nd place =     $1,000
3rd place =     $500

The Overall Prizes will be awarded by a panel of qualified judges selected by Cellular South, based on “Judging Criteria” specified below.  The Overall Prizes will be awarded on or about the week of July 27th, 2009.
 
Best-In-Category prizes: Five (5) individually selected netbook Best-In-Category prizes. One (1) netbook (valued at approximately $400) will be awarded to each individual Best-In-Category winner in each of the following five (5)  categories: Abstract, Sports, Outdoors, Old School and Future. The Best-In-Category prizes will be awarded by a panel of qualified judges selected by Cellular South, based on “Judging Criteria” specified below.   These prizes will be awarded on or about the week of July 27th, 2009.

Weekly prizes: Three (3) individually selected Weekly Prizes of $250 cash each (total of $750 in weekly prizes). The weekly prizes will be awarded by a panel of qualified judges selected by Cellular South, based on “Judging Criteria” specified below.   These prizes will be awarded on or about following dates: Week of 6/29/09, 7/6/09, and 7/13/09. 
 
Everyone has a chance for their design or photo to be featured on the online Discover Center.
 
Entries will consist of content submitted by the entrant who relates to the creative assignment and other criteria set forth herein.  Content submitted by entrants has the chance of being featured on Cellular South’s online Discover Center (cellularsouth.com/DiscoverCenter).
 
There will be no substitutions for prizes.  Prizes awarded are non-transferable.  Failure to collect a prize within thirty (30) days of notification of award constitutes forfeiture of the prize.  If forfeited, the prize will remain the property of Cellular South.  Another winner will not be selected.
 
SELECTION OF WINNERS:
 
ALL prizes will be awarded by a judging process in which a panel of judges selected by Cellular South will evaluate each eligible content submission based on the following criteria.

CREATIVE ASSIGNMENT: 
 
The Overall Prizes will be awarded based on how the content submission stacks up against the following Judging Criteria:
 
(#1) Originality and Creativity – 40%
(#2) Adherence to Creative Assignment – 30%
(#3) Overall Appeal – 30%
 
Contest and submissions can be managed by third-party vendor -- memelabs -- and launch on June 22, 2009.

NO PURCHASE NECESSARY.  Contest is open to legal residents of the United States who are 19 years of age or older and who reside in the State of Alabama, and who are 18 years of age or older and who reside in the States of Mississippi and Tennessee, as of the date of entry.  Minors are ineligible to participate in the Contest.  Best-In-Category, Weekly and Overall Prize winners must possess a valid Alabama, Mississippi or Tennessee driver’s license.  Offer void where prohibited by law.  The period for participation in the Contest is from 8:00 AM CT, June 22nd, 2009 through 11:59 PM CT, July 19th, 2009.  For purposes of these Official Rules all times are Central Time (CT).
 
ELIGIBILITY Employees, agents, resellers, distributors, officers or directors of Cellular South, and their respective parent companies, affiliates, subsidiaries, advertising / promotional agencies, and the members of their immediate families or those persons living in the same household of such individuals are ineligible to enter the Contest or win a prize.  The term “immediate families” includes spouses, grandparents, parents, siblings, children, and grandchildren.  All federal, state and local laws and regulations apply.  Void where prohibited by law.  Difficulties with online access to enter the Contest are not the responsibility of Cellular South or memelabs.com.
 
HOW TO ENTER.  To enter the Contest, register at www.cellularsouth.com/netbookchallenge during the above-mentioned time period and submit your entry.  All entries must comply with the Design Creation Requirements found on the registration page.

LIMIT: One entry per person, per day. 
 
CHANGE OF ADDRESS POLICY   It is the sole responsibility of the entrant to notify Cellular South in writing if the entrant changes his / her address, e-mail address, and / or telephone number.  To do so, write to Cellular South, Attn:  Marketing / Cellular South Netbook Design Challenge Contest, 1018 Highland Colony Parkway, Suite 340, Ridgeland, MS  39157.
 
By participating in the Contest entrants release Cellular South and its parent company, affiliates, subsidiaries, advertising / promotional agencies, and the employees, officers, directors and agents of any of the above organizations from any and all liability for any claims, injuries, losses, or damages of any kind caused by participation in the Contest or the acceptance, possession or use / misuse of a prize or participation in any prize-related activities.  Where legal, by accepting a prize the winner grants Cellular South permission to use his / her name, address, likeness, photograph, Contest submission, and statements in advertising and for other promotional or publicity purposes without further compensation.
 
Cellular South reserves the right to make changes to these Official Rules without notice at any time.
 
OFFICIAL WINNERS For a copy of the Official Winners’ announcement, (available approximately July 27th, 2009.) mail a self-addressed stamped envelope by July 27th, 2009 to:  The Cellular South Netbook Design Challenge Winner’s Announcement, 1018 Highland Colony Parkway, Suite 340, Ridgeland, MS  39157.
 
This Contest is sponsored by Cellular South, 1018 Highland Colony Parkway, Suite 340, Ridgeland, MS  39157.  The decision of Cellular South management in their interpretation of these Official Rules is final.  By participating in the Contest each entrant agrees to be bound by the decisions of Cellular South’s management, the decisions of the Contest judges, and these Official Rules.
 
Cellular South, their representatives, agencies and employees, are not responsible for any changes or difficulties in prize delivery.  This Contest and all accompanying materials are copyright © 2009 by Cellular South.

Your participation in the Contest, including your submission of an image of photograph to Memelabs.com shall be deemed to be your complete acceptance of the terms and conditions set out below by Memelabs.com (hereinafter referred to as Organizer) and Cellular South, Inc. (hereinafter referred to as Sponsor).
 
CHILDREN AND MINORS:  Consistent with the Federal Children's Online Privacy Protection Act of 1998 (COPPA), we will never knowingly request personally identifiable information from anyone under the age of 13 without requesting parental consent.  Additional information can be found on the U.S. Federal Trade Commission Web site.  Any entrant must obtain all necessary permissions from anyone else featured in his/her submission, including permission from parents or legal guardians of minors included in such submission (written proof of such permission must be made available to Sponsor upon request).
 
ELIGIBILITY:  The Contest is open only to individual legal residents of the States of Mississippi, Alabama (must be 19 years of age or older), and Tennessee who have internet access, are 18 years of age or older at the time of entry.   Void where prohibited or restricted by law.  Employees, contingent staff persons, officers and directors, together with relatives (parents, grandparents, children, grandchildren, siblings and spouses of each) and/or those  living in the same households, of Invoke Media, Memelabs, and their respective parents, subsidiaries and affiliates are ineligible to participate in the Contest or win any Contest prize.

Entry to the Contest is only open to persons of at least 18 years of age (age 19 required in Alabama).
 
Employees and relatives of employees of Sponsor and Organizer and any entities affiliated or related to Sponsor and Organizer are not eligible to enter the Contest.  For this purpose, the term "relative" shall mean spouse, partner, parent, grandparent, child, grandchild or sibling.
 
By submitting your Submission to the Organizer in relation to the Contest you agree to and thereby waive any and all property rights of any kind including, but not limited to, intellectual property rights or moral rights that exist in your submission to the Contest and any derivative works made there from.
 
By submitting your submission to the Organizer in relation to the Contest you represent, warrant and undertake to Sponsor and Organizer that your submission
        (i) is your own original work and that you have the sole right to submit it to the Contest,
        (ii) does not violate in any way the rights of any third parties including, but not limited to, copyright and other intellectual property rights, and
       (iii) does not violate any applicable laws.
 
In the event that you breach any of your representations, warranties or undertakings contained herein, you agree to indemnify and hold harmless Sponsor and Organizer from and against any and all damages, costs, expenses (including reasonable attorneys’ fees), and claims of any kind or nature which are incurred by Sponsor or Organizer as a result of your breach.
 
Your Submission to the Contest should not include any content whatsoever which would reasonably be understood to be defamatory, threatening, distasteful, racist, unlawful or otherwise objectionable.
 
Sponsor and Organizer reserve the right to alter or modify your submission to the Contest without notification or consent from you.
 
Sponsor and Organizer reserve the right to change these terms and conditions at any time and at their sole discretion.
 
Entrant agrees to grant to Sponsor and Organizer an everlasting, royalty-free, assignable, exclusive license to use, utilize, replicate, alter, adapt, modify, publish, broadcast, translate, produce derivative works from, distribute, present, play, sublicense and exercise all copyright and other intellectual property rights with respect to their Submission on a worldwide basis and/or to include their Submission in other works in any media now known or later created forever.  Entrant agrees and grants Sponsor and Organizer permission to make available and display/perform and otherwise distribute entrant's name and video submission in all media in perpetuity without compensation.  Except where legally prohibited, submission of an entry into this Contest constitutes permission for Sponsor and Organizer to use the entrant's name, photograph, likeness, voice, address (city and province/state) and testimonials, in printed, broadcast media or new media, in perpetuity, in any manner they deem appropriate in connection with promoting the submission itself or this Contest, without further compensation in connection with this Contest or the prize awarded.
 
Each entrant agrees to indemnify and hold Sponsor harmless from any third-party claims arising from or related to that entrant's participation in the Contest.  By participating, entrants agree that Sponsor and Organizer’s involvement in the development, production, implementation and distribution of this Contest and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Contest, including entry and participation in this Contest and acceptance, possession, use or misuse of the prizes.  All entrants further agree that in the event  of any third-party claims, damages, losses or injuries, arising from or relating to this Contest, they will indemnify and hold Organizer and Sponsor harmless from any and all such claims, damages, costs, and expenses (including the attorneys' fees) related thereto.  Organizer and Sponsor shall not be responsible for any technical malfunctions of the telephone network, computer online system, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any injury.  
 
Entrants participating in this Contest are liable for any copyright infringements caused by their image or submission.
 
Entrant is responsible for securing permission from all talent included in the entrant’s submission.  Sponsor and Organizer assume no responsibility for royalties or fees associated with the persons being portrayed in the submission.
 
Sponsor and Organizer assume no responsibility for lost or late entries or for incomplete computer transmissions or technical failures.
 
Sponsor and Organizer reserve the right not to accept entries that are considered inappropriate for the Contest.
 
Notification 
 
• The winners will be contacted at the telephone, address, and/or e-mail address provided during registration. 
• The winners and title of their entry will be announced on the Organizer’s Web site and may be announced on the Sponsor’s Web site.
• The winning images will be featured on the Contest Web site. 
• Prizes will be delivered shortly after the winners are chosen and announced.  
 
Design Creation Requirements  
 
• Acceptable sources for image content include sources for which the content is not copyrighted.  Contestant takes responsibility that all images are not copyrighted material of a third party.  This means, do NOT use commercial copyrighted images.  
 
• Images may not contain obscene language or content, including but not limited to: nudity, profanity, or graphic violence. 
 
• Images must be at least 1024 X 576 pixels in size
 
• I mages submitted must be in the png, jpeg or gif format
 Files larger than 30MB will not be accepted. 
 
    Photos can be shot with camera phones, digital Photo cameras or any other camera format but must be converted to a digital image format for entry to the contest. File  size should not exceed 30MB. No video entries will be accepted.
