OFFICIAL CONTEST ENTRY RULES
NO PURCHASE NECESSARY. The Panama City Beach CVB Real Fun Contest is open to legal residents of the United States and the District of
Columbia who are 25 years of age and older. The Contest begins at 8 a.m. CDT, on May 25, 2009 and ends at 12:00 p.m. CDT, on July 31, 2009.
HOW TO ENTER:
Visit the “Panama City Beach Real Fun Contest” section of www.VisitPanamaCityBeach.com or www.realfuncontest.com between 8 a.m. CDT, on May 25, 2009 and 12:00 p.m. CDT, on July 31, 2009.
Each entrant will be required to upload an original video explaining why you are the best representative for one of five different personalities outlined on www.realfuncontest.com, and complete the Official Registration Form by following the instructions provided on the website. No other methods of entry will be accepted. Limit one (1) entry per person. Entries are limited to individuals only; commercial enterprises and business entities are not eligible. Sponsor is not responsible for incorrect or inaccurate entry of information by participants; lost entries or transmissions, interrupted or unavailable network, server, or other connections; scrambled transmissions or other errors or problems of any kind whether mechanical, human, or electronic, technical malfunctions or the computer hardware, software, or any combination thereof; or problems associated with any virus or any other damage caused to participants’ systems. Incomplete entries will be voided. All entries and submitted content become the property of the Panama City Beach CVB, will not be returned, and may be used in advertising and publicity without compensation. By entering, Entrant agrees that if he or she is selected as the winner of one of vacation package prizes (see Prizes), Entrant grants Sponsor and/or its affiliates, agents, and licensees permission to film and/or photograph Entrant and/or guests during use of Prize, at a time and place to be mutually agreed upon by Entrant and Sponsor, and grants Sponsor the unconditional and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used) such film, video, and/or photograph without compensation and limitation (see Conditions of Entry).
JUDGING:
Eligible entries will be judged by staff of the Panama City Beach CVB and/or its designee(s) to the select the top ten finalists for each web personality outlined on www.realfuncontest.com, this judging will begin at 12:01 p.m. CDT, on July 31, 2009 and end 12:00 p.m. CDT, on August 1, 2009. Each video will be treated as a single work and will be judged as a whole. Finalist videos will be posted by 5 p.m. CDT on August 1, 2009 and will be judged by visitors to www.realfuncontest.com from 5 p.m. CDT on August 1, 2009 and end at 5 p.m. CDT on September 10, 2009. Winners will be announced on September 11, 2009.
Voting will be limited to one vote per person, per email address, per day during the entire Voting Period. The entry with the most consumer votes will win the personality vacation pack prize they have entered in (see Prizes).
CONDITIONS OF ENTRY:
As conditions of entry into this Contest, and by uploading and entering a Submission, Entrant warrants and represents that the Submission (a) is original and has been legally created by the Entrant, (b) does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party; (c) has not been entered in or won previous Contest or awards; and (d) has not been published or distributed previously in any media. Entrant represents that he/she owns all rights to his/her Submission, including, without limitation, the copyrights in the recording and the performance contained therein. Entrant further represents and warrants that the Entrant has obtained permission from each person whose name, image or likeness is included in the Submission, and that such person(s) have granted Entrant all necessary rights to use the person's Likeness as described in these rules, and that Entrant can make written copies of such permissions available to the Sponsor (Panama City Beach CVB) upon request. If the Likeness of a minor is included, such grant of rights must include written permission from the minor's parent or legal guardian authorizing the use of the minor's likeness on behalf of the minor. By uploading a Submission, Entrant irrevocably grants Sponsor and its affiliates, legal representatives, assigns, agents and licensees, the unconditional and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), the Entrant's Submission, including, but not limited to, the recording and the performances contained therein (in each case, as submitted or as edited/modified in any way by the Sponsor, in its sole discretion), as well as to use Entrant's name, likeness, photograph (collectively, "Likeness"), and/or statements regarding his/her participation in this Contest (with or without using the Entrant's name) in any and all media without limitation as to time or territory, and without additional compensation or approval from the Entrant or any other party. Entrant waives intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude the Sponsor's use of the submission, and agrees not to sue or assert any claim against the Sponsor for the use of the Submission or Entrant's Likeness or statements. Entrant agrees to indemnify and hold Sponsor, its agencies and their respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the "Indemnities"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Indemnities due to or arising out of the Entrant's Submission, or the Entrant's conduct in creating a Submission or otherwise in connection with this Contest, including but not limited to claims for trademark infringement, copyright infringement; violation of an individuals right of publicity or right of privacy; or defamation. Entrant further agrees to release Sponsor from any and all claims that any advertising subsequently produced, presented, and/or prepared by or on behalf of Sponsor infringes Entrant's rights with regard to any elements, characters or ideas contained in any submission. Entrant agrees that if he or she is selected as the Winner of the personality vacation package prize (see Prizes), Entrant irrevocably grants Sponsor and/or its affiliates, agents, and licensees permission to film and/or photograph Winner and/or his or her guests during use of Prize, at a time and place to be mutually agreed upon by Winner and Sponsor, and gives Sponsor the unconditional and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used) such photograph (collectively, "Likeness"), without compensation and limitation; including, but not limited to, the use of the Winner's and/or guests’ name, likeness, photograph and/or statements regarding his/her participation in this Contest (with or without using the Entrant's name) in any and all media without limitation as to time or territory, and without additional compensation or approval from the Winner, his or her guests, or any other party. Winner and his our her guests waive intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude the Sponsor's use of the photograph, and agrees not to sue or assert any claim against the Sponsor for the use of the Winner’s and guests’ Likeness or statements. Winner agrees to indemnify and hold Sponsor, its agencies and their respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the "Indemnities"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Indemnities due to or arising out of the Sponsor’s use of Winner’s and guests’ Likeness, or the Winner’s and guests’ conduct in connection with this Contest, including but not limited to claims for trademark infringement, copyright infringement; violation of an individuals right of publicity or right of privacy; or defamation. Winner and guests further agree to release Sponsor from any and all claims that any advertising subsequently produced, presented, and/or prepared by or on behalf of Sponsor infringes Winner’s and his or her guests’ rights with regard to any elements, characters or ideas contained in any use of Winner’s and his or her guests’ Likeness.
ELIGIBILITY:
Open to all legal residents of the U.S. who are 25 years or older at time of entry, except employees of Panama City Beach CVB, TDC Board Members or their employees, their advertising and promotion agencies, prize providers, and their immediate family members and those living in the same household are not eligible to enter. Limit one (1) entry per person. All applicable federal, state and local laws apply. No entry fee, payment, or proof of purchase necessary to enter Contest. Void where restricted or otherwise prohibited by law.
