Rules
No Purchase Necessary

The “Your PBS” Video Contest (“Contest”) is sponsored by Public Broadcasting Service, with its principal place of business at 2100 Crystal Drive, Arlington, VA 22202 (“Sponsor” or “PBS”). The Contest is hosted and organized by Memelabs.com, with its principal place of business at 37 Dunlevy Avenue, Vancouver, BC, Canada, V6A 3A3 (“Organizer”). Contest is void where prohibited. By entering, each entrant accepts and agrees to be bound by these Official Rules.

How to Enter

No purchase is necessary to enter or win this Contest. The Contest begins on February 12, 2010 at 5:00:00 p.m. and ends on April 25, 2010 at 11:59:59 pm EST (the “Entry Period”). Entrants may enter this Contest by visiting www.memelabs.com/pbs (“Site”). They will be required to register by creating a username and password and entering a valid e-mail address. Then they can log in to upload their video after completing a brief entry form (providing their full name, date of birth, full address and phone number). Video entries should show how the contestant has discovered new ideas, met new people, visited new places or explored new topics through PBS on the web in a way that might be surprising to some people. Entry is limited to three videos per person.

Eligibility

This Contest is open only to legal residents of the United States, including Hawaii and Alaska but excluding U.S. territories, and entry to the Site is only open to persons of at least 18 years of age. Employees and relatives of employees of Sponsor and Organizer and any entities affiliated or related to Sponsor and Organizer ARE eligible to enter the contest, but they are not eligible to win a prize. Winners will be required to sign an affidavit of eligibility and liability release form (except where prohibited) affirming their agreement to all terms, conditions, and restrictions in these Official Rules.

Prizes

Seven (7) Overall Prizes with a total approximate retail value of $4,250 will be awarded as follows:

Grand Prize
One (1) Grand Prize winner will receive a trip to the 2010 PBS Annual Meeting in Austin, TX on May 18-19, 2010. Grand Prize includes: round-trip airfare (within the United States), transportation to and from the airport to a hotel of PBS’ choosing, two (2) nights in a hotel, one (1) day attendance at the PBS meeting (where the winner will attend upcoming programming sessions), meals and pocket money to cover incidentals in Austin, a coffee meeting with a PBS Programming executive, a tour of Austin PBS station KLRU and the Austin City Limits set, a limited edition PBS-Designed flip camera, and a PBS Gift Pack. (Approximate retail value $3,000.00)

Runners Up Prizes
Five (5) runners up will receive a limited edition PBS-Designed flip camera and a PBS Gift Pack. (Approximate retail value $500.00)

People's Choice Prize
The creator of the video receiving the greatest number of public votes will receive a limited edition PBS-Designed Flip camera, a PBS Gift Pack and a $250.00 Gift Certificate to ShopPBS.org. (Approximate retail value $750.00)

Odds of winning will depend on the number of entries received. The Overall Prizes will be awarded by a panel of qualified judges selected by PBS, based on the Judging Criteria specified below. The Overall Prizes will be awarded on or about the week of May 3rd. Actual retail value may vary. Winners will not receive difference between actual and approximate retail value. There will be no substitutions for prizes. Prizes awarded are non-transferable and may not be exchanged or redeemed for cash, sold, or traded. Sponsor and/or Organizer reserve the right to substitute a prize, in which case a prize of equal or greater value will be awarded. Failure to collect a prize within thirty (30) days of notification of award constitutes forfeiture of the prize. If forfeited, the prize will remain the property of PBS. Another winner will not be selected.

Judging Criteria

Videos will be judged based on whether they meet the video creation and entry requirements, how well they follow the directive provided by PBS, the quality of the video and whether the video is clever, engaging and/or innovative. A panel of five (5) judges will evaluate submissions based on the judging criteria.

Videos should be about thirty (30) seconds long. Videos can be shot with camera phones, digital video cameras, or any other digital moving image format. No still photo entries will be accepted. All entries must be received by 11:59:59 p.m. on April 25, 2010. There is no cost or purchase required to enter the Site or submit a video.

Video Creation Requirements

Acceptable source video includes sources that are not copyrighted. Participant takes responsibility that all images and soundtracks are not copyrighted material. This means, do NOT use commercial copyrighted music or images. Participants will be provided links to rights-cleared music for this Contest.
Videos may not contain obscene language or content, including but not limited to: nudity, profanity, or graphic violence.
Video must be about 30 seconds long.
Video can be in any format. Files larger than 32 MB will not be accepted.
Videos must be submitted via the web as instructed after registration. If you have problems uploading, please contact us at info@memelabs.com. If you are having problems uploading, you must contact us before the contest deadline.

Voting

The public can vote daily on their favorite video at www.memelabs.com/pbs or www.pbs.org starting on February 12, 2010 at 12:00:01 am EST and ending on May 7, 2010 at 11:59:59 pm EST ("Voting Period"). The Voting Period is separated into eighty-five (85) Daily Voting Periods. A "Day" is defined as the 24 hours between 12:00:00 a.m. (midnight) EST and 11:59:59 p.m. EST. Sponsor's computer is the official time keeping device for the Contest.

The first time voters visit the site, they will be required to register by creating a username and password and providing their e-mail address. By submitting a vote, the visitor warrants and represents that they agree to the Official Rules. Voters may not Vote with multiple email accounts. Votes must be submitted and received to the Website during the Voting Period. Limit one (1) Vote per person/registered users/email address per Day.

At the close of the Voting Period, the submission that receives the most votes will be deemed the People's Choice Winner ("People's Choice Winner"). In the unlikely event that public voting results in a tie, the tied Submissions will be re-judged by the contest Judges based on the Judging Criteria stated in the rules. Any use of robotic, macro, automatic, programmed or like voting methods will void all such votes. Any attempt by Finalist and/or his/her family/friends to vote more than the number of times authorized herein using multiple names, email addresses, phone numbers and/or any other fraudulent mechanism, as determined by Sponsor in its sole discretion, shall give Sponsor the right to disqualify Finalist in its reasonable discretion.

Conditions and Restrictions Apply

Your participation in this Contest, including your submission of a video to memelabs.com, shall be deemed to be your complete acceptance of the terms and conditions set out in these Official Rules. Additional conditions and restrictions apply:

By submitting your contribution to the Organizer in relation to the Site you agree to and thereby waive any and all moral rights that exist in your contribution to the Site and any derivative works made there from.
By submitting your contribution to the Organizer in relation to the Site you represent, warrant and undertake to Sponsor and Organizer that your contribution (i) is your own original work and that you have the sole right to submit it to the Site; (ii) does not violate in any way rights of third parties including copyright and other intellectual property rights; and (iii) does not violate any applicable laws.
Your contribution to the Site should not include any content whatsoever which would reasonably be understood to be defamatory, threatening, distasteful, racist, unlawful or otherwise objectionable.
Sponsor and Organizer reserve the right to change these terms and conditions at any time and at its sole discretion.
Entrants agree to grant to Sponsor and Organizer an everlasting, royalty-free, assignable, exclusive license to use, utilize, replicate, alter, adapt, modify, publish, broadcast, translate, produce derivative works from, distribute, present, play, sublicense and exercise all copyright and other intellectual property rights with respect to your contribution worldwide and/or to include your contribution in other works in any media now known or later created forever. Each entrant agrees and grants Sponsor and Organizer permission to make available and display/perform and otherwise distribute entrant's name and video submission in all media in perpetuity without compensation. Except where legally prohibited, submission of an entry into this Site constitutes permission for Sponsor and Organizer to use the entrant's name, photograph, likeness, voice, address (city and province/state) and testimonials, in printed, broadcast or new media, in perpetuity, in any manner they deem appropriate in connection with promoting the video submission itself or this Site, without further compensation in connection with this Site or the prize awarded.
Entrant is responsible to secure permission from all talent included in the video. Sponsor and Organizer assume no responsibility for royalties or fees associated with talent performances in the entered videos.
Sponsor and Organizer assume no responsibility for lost or late entries or for incomplete computer transmissions or technical failures.
Sponsor and Organizer reserve the right not to accept entries that are considered inappropriate for the Site.
Winners are subject to verification by Sponsor and Organizer, whose decisions are final and binding in all matters related to the Contest. An entrant is not a winner of any prize unless until entrant’s eligibility has been verified and entrant has been notified that verification is complete. Winners will be required to execute and return a liability release and affidavit of eligibility (except where prohibited) within ten [10] days of notice of winning.
Winners will be solely responsible for any and all local, state, and federal taxes. Sponsor and Organizer will report any individual winnings over $600 (in cash or fair market value of goods or services) in a one-year period to the Internal Revenue Service. Winners will receive a Form 1099 from Sponsor or Organizer if Sponsor or Organizer reports any winnings to the Internal Revenue Service.

Limitation on Liability

In the event that you breach any of your representations, warranties or undertakings contained herein, Sponsor and Organizer shall be entitled to and may seek indemnification from you for recovery of all legal fees, damages, claims and other expenses that may be incurred by Sponsor or its affiliated entities as a result of your aforementioned breach.
Each entrant agrees to indemnify Sponsor from any third party claims arising from or related to that entrant's participation in the Site. By participating, entrants agree that Sponsor, Organizer involved in the development, production, implementation and distribution of this promotion and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Site, including entry and participation in this Site and acceptance, possession, use or misuse of the prizes. All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to this Site, they will indemnify Organizer and Sponsor from any and all such claims, including the attorneys' fees related thereto. Organizer and Sponsor shall not be responsible for any technical malfunctions of the telephone network, computer online system, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any injury.
Entrants participating in this Site are liable for any copyright infringements caused by their videos.

Memelabs Privacy Policy

Memelabs, Inc. ("Memelabs," "we" or "us") provides this Privacy Policy to inform you of our policies and procedures regarding the collection, use and disclosure of personal information we receive from users of www.Memelabs.com and our media player which enables users to stream and broadcast content (collectively, the "Services"). This Privacy Policy applies only to information that you provide to us through the Services. This Privacy Policy may be updated from time to time. We will notify you of any material changes by posting the new Privacy Policy on the Site. You are advised to consult this policy regularly for any changes. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Memelabs Terms of Service.
As used in this policy, the terms "using" and "processing" information include using cookies on a computer, subjecting the information to statistical or other analysis and using or touching information in any way, including, but not limited to collecting, storing, evaluating, modifying, deleting, using, combining, disclosing and transferring information within the United States or internationally.

Information Collection and Use
Our primary goals in collecting information are to provide and improve our Services, features and content, to administer your membership and to enable users to enjoy and easily navigate the Site. We also may also use your information in order to better understand how our Services are used.

Personally Identifiable Information

In the course of using the Services, we ask you to provide us with certain personally identifiable information that can be used to contact or identify you and administer your account ("Personal Information"). Personal Information may include, but is not limited to, your name, phone number, credit card or other billing information, email address and home and business postal addresses. We use your Personal Information mainly to provide the Services and administer your inquiries.
* Please be aware that when you register to become a Memelabs Member, other users of the Services may be able to see your screen or user name, in addition to any comments or submissions that you post to the Site or submit via the Services. We recommend that you guard your anonymity and sensitive information and that you not use your real name as your screen or user name to the extent that it allows others to identify you.
* We also collect the other information that you provide as part of your use of the Services, including via your registration and the administration and personalization of your profile webpage (e.g., without limitation zip code and individual preferences) ("Non-Identifying Information"). Certain Non-Identifying Information would be considered a part of your Personal Information if it were combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be identified. But the same pieces of information are considered Non-Identifying Information when they are taken alone or combined only with other non-identifying information (for example, your viewing preferences). We may combine your Personal Information with Non-Identifying Information and aggregate it with information collected from other Memelabs Users to attempt to provide you with a better experience, to improve the quality and value of the Services and to analyze and understand how our Services are used.
* We also use your Personal Information to contact you with Memelabs newsletters, marketing or promotional materials and other information that may be of interest to you. Memelabs Members who agree to the terms and conditions of the Memelabs Terms of Service Agreement are given the opportunity to opt into receiving such communications from us in the future. If you decide at any time that you no longer wish to receive such communications from us, please follow the unsubscribe instructions provided in any of the communications or update your "user preferences" information. (See "Changing or Deleting Information," below.)

Log Data

As you use the Services, whether as a Memelabs Member or a non-registered user just browsing (any of these, a "Memelabs User"), our servers automatically record information that your browser sends whenever you visit a website ("Log Data"). This log data may include information such as your computer's IP address, browser type or the domain from which you are visiting. We use this information to monitor and analyze use of the Services and for the Site's technical administration. We do not treat Log Data as Personal Information or use it in association with other Personal Information, though we may aggregate, analyze and evaluate such information for the same purposes as stated above regarding other Non-Identifying Information.

Cookies
Like many websites, we use "cookies" to collect information. A cookie is a small data file that we transfer to your computer's hard disk for recordkeeping purposes. We use cookies for two purposes. First, we utilize persistent cookies to save your registration ID and login password for future logins to the Site. Second, we utilize session ID cookies to enable certain features of the Services, to better understand how you interact with the Services and to monitor aggregate usage by Memelabs Users and web traffic routing on the Services. Unlike persistent cookies, session cookies are deleted from your computer when you close your browser. Third party advertisers on the Services may also place or read cookies on your browser. You can instruct your browser, by editing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions of the Site or all functionality of the Services.

Emailing Via a Memelabs Account
As part of the Services, Memelabs Members are able to communicate with Memelabs Members and non-members through use of their accounts. Where Memelabs Members have selected the option of adding one or more email addresses to an online form, the message they create in the corresponding template can be sent from Memelabs to those email addresses on their behalf. These email addresses will be stored in the address book the Memelabs Member creates and will only be used for the purpose of sending the email communication to the addressee.

Information Sharing and Disclosure
Memelabs Members. When you register through the Site and submit your Personal Information to create a profile webpage, Memelabs Users will see your "Screen Name" and the month and year you first registered with Memelabs ("Required Member Identifiers"). You can choose what other Personal Information you provide as part of your profile ("Other Member Information") and in some cases you can choose whether to share that information publicly on the Site by making selections via the "user preferences" section of your profile webpage. Providing Other Member Information is voluntary and should correlate with the degree of interaction you want to have with Memelabs Users. We recommend that you guard your anonymity and sensitive information.

Aggregate Information and Non-Identifying Information
We may share aggregated information which does not include Personal Information and we may otherwise disclose Non-Identifying Information and Log Data with third parties for industry analysis, demographic profiling and other purposes. Any such aggregated information will not contain your Personal Information.

Service Providers

We may employ third party companies and individuals to facilitate our Services, to provide the Services on our behalf, to perform Site-related services (e.g., without limitation, maintenance services, database management, web analytics and improvement of the Site's features), or to assist us in analyzing how our Services are used. These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Compliance with Laws and Law Enforcement

Memelabs cooperates with government and law enforcement officials or private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of Memelabs or a third party, to protect the safety of the public or any person, or to prevent or stop any illegal, unethical or legally actionable activity.

Business Transfers

Memelabs may sell, transfer or otherwise share some or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy. If Memelabs becomes involved in a merger, acquisition, reorganization or any form of sale of some or all of its assets, we will provide notice to you before your Personal Information is transferred and becomes subject to a different privacy policy.

Changing or Deleting Your Information
All Memelabs Members may review, update, correct or delete the Personal Information in their registration profile by contacting us. If you completely delete all such information, then your account may become deactivated. If you would like us to delete your record in our system, please contact us and we will attempt to accommodate your request. See below for privacy contact information.

Security
Memelabs is very concerned with safeguarding your information. We employ administrative, physical and electronic measures designed to protect your information from unauthorized access. We will make any legally required disclosures of any breach of the security, confidentiality or integrity of your unencrypted electronically stored Personal Data (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting on this Site in the most expedient time possible and without unreasonable delay, insofar as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

International Transfer
Your information may be transferred to - and maintained on - computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide information to us, Memelabs transfers Personal Information to the United States and processes it there. Your submission of such information represents your agreement to that transfer.

Links to Other Sites
The Services contain links to other websites. If you choose to visit an advertiser by clicking on a banner ad or other type of advertisement, or click on another third-party link, you will be directed to that third party's website. The fact that we link to a website or present a banner ad or other type of advertisement is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over third party websites. These other websites may place their own cookies or other files on your computer, collect data or solicit personal information from you. This Privacy Policy addresses the use and disclosure of information that we collect from you through our Services. Other sites follow different rules regarding the use or disclosure of the personal information you submit to them. We encourage you to read the privacy policies or statements of the other websites you visit.

Our Policy Toward Children
Memelabs does not knowingly collect personally identifiable information from children under 13. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us at Privacy@Memelabs. If we become aware that a child under 13 has provided us with Personal Information, we will delete such information from our files.
